Fairness, Evidence and Access to Justice in Australian Family Law

To the Honourable the Speaker and Members of the House of Representatives assembled in Parliament:

The petition of the undersigned draws to the attention of the House the serious effects that delay, unaffordable representation, untested allegations and inconsistent procedural fairness can have on children and families in parenting proceedings. Genuine reports of abuse and danger must be taken seriously and investigated carefully. At the same time, decisions affecting children and parents should be timely, impartial and based on properly tested evidence, with each party given a meaningful opportunity to be heard.

We therefore ask the House to support an independent review of family law processes and resources, including measures to improve timely hearings, access to legal assistance, careful and balanced assessment of allegations, disclosure of relevant evidence, child-focused decision-making and accountability for deliberate misuse of legal processes, while maintaining strong protections for genuine victims and children at risk.

Evidence and Procedural Fairness in Criminal Justice

To the Honourable the Speaker and Members of the Legislative Assembly of the Parliament of Western Australia in Parliament assembled:

We, the undersigned residents of Western Australia, ask the Legislative Assembly to consider the harm caused when criminal allegations arising during high-conflict family disputes are not investigated with sufficient independence, timeliness and attention to evidence supporting and contradicting an allegation. Every genuine victim must be safe to report and receive protection. Every accused person must also retain the presumption of innocence and a fair opportunity to answer an allegation.

We therefore request an independent review of relevant investigative and prosecutorial practices, including timely disclosure, objective assessment of inculpatory and exculpatory material, access to representation, safeguards against deliberate misuse of legal processes, and appropriate accountability where knowingly false evidence is proven, while preserving strong protections for genuine victims, witnesses and children.

Final wording must be accepted by a facilitating Member and the Clerk before publication on Parliament’s e-petition system.

What happens next

  2. Federal request submitted when the campaign is ready for its four-week signing period.
  3. WA request provided to a local Member of the Legislative Assembly willing to facilitate it.
