Family decisions can shape an entire childhood.
Parenting proceedings may affect a child’s safety, stability, relationships, schooling and long-term wellbeing. They can also place major emotional and financial pressure on families. Justice Before Judgment supports reform that improves the quality and speed of decision-making without dismissing genuine risk or predetermining either parent.
The campaign does not claim that every allegation is false. It asks that serious reports be acted on, relevant evidence be gathered promptly and every final decision be reached through a fair and independent process.
Children’s best interests
The Federal Circuit and Family Court explains that a child’s best interests are the paramount consideration in parenting disputes.
OFFICIAL COURT INFORMATION ↗Prompt action on risk
The Court explains that allegations of child abuse or family violence require prompt consideration and may require evidence from relevant agencies.
COURT SAFETY GUIDANCE ↗Fair hearing safeguards
Australian Government guidance describes core fair-hearing protections, including an independent tribunal and a fair, public hearing subject to lawful limits.
ATTORNEY-GENERAL GUIDANCE ↗What better process can look like
Relevant records and independent information should be obtained early enough to guide safe interim and final decisions.
People affected by serious claims should know the substance of the case and have a fair opportunity to respond.
Access to essential legal help, mediation and expert services should not depend entirely on personal wealth.
Unnecessary delay can deepen harm. Important issues should move toward properly informed decisions as efficiently as safety permits.
Deliberate fabrication, concealment or misuse should be distinguished from good-faith reports and addressed through lawful, evidence-based findings.
What this campaign is not asking for
- It is not asking courts to ignore family violence, child abuse or genuine safety concerns.
- It is not asking for automatic outcomes based only on gender or parent status.
- It is not asking for people to be punished merely because an allegation is unproven.
- It is not attempting to decide any individual family law case online.
Read the prepared federal request.
The public campaign register is separate from a future official parliamentary petition. The federal draft keeps the request with the Parliament responsible for Commonwealth family law.
